Chief Compliance Officer

Request for Submission of Letter of Intent to Bid to Provide
Investigative/Compliance Services to the New York City District Council of Carpenters Benefit Funds

The Board of Trustees of the New York City District Council of Carpenters Pension, Welfare, Annuity, and Apprenticeship, Journeyman Retraining, Educational and Industry Funds (collectively, the “Funds”) is seeking to engage a person or firm who or which specializes in providing investigative and compliance services to sophisticated and complex clients. The Funds have had a self-imposed compliance program since 2012.

Qualified persons or firms are invited to submit a letter of intent to bid by May 17, 2024. The letter of intent should be submitted by email to resumes@kmm.com. The next steps for selected candidates will be submission of a written proposal (with detailed information on credentials, experience, track record, staffing, fee structure, and references) and in-person interviews. A description of the Funds is set forth below. Additional information regarding the Funds is available on the Funds’ website at www.nyccbf.org.

The primary responsibilities of the selected person or firm will be to:

-Have direct responsibility and oversight for the Funds’ Compliance and
Ethics Program (“CEP”), including:
o providing one initial and then subsequent periodic assessments of the
Funds’ CEP;
o developing new or supplemental policies and protocols to enhance the
Funds’ CEP;
o making recommendations to the Board of Trustees on how to ensure
that the CEP is appropriately tailored to the needs of the Funds;
o investigating allegations pertaining to violations of the CEP; overseeing the Funds’ complaint lines;
o serving as an advisor for employees and the Board of Trustees
regarding the CEP; and
o conducting periodic training in compliance and ethics for all employees
and Trustees;

-Assist in identifying, assessing and mitigating risks and threats to the Funds; and

-Providing ad hoc assistance or leadership on compliance projects to be
determined.

The successful candidate will have the following experience and skills:

-Compliance Expertise:
o Proven track record in designing, implementing, and managing
effective compliance programs for complex and significant organizations.
o Ability to assess risks, develop policies, and monitor adherence.
o Strong analytical skills to proactively identify potential compliance
gaps or violations and appropriate corrections and resolutions.
o While prior experience with comparable organizations is a plus but not
a requirement, the successful candidate must be able to acquire an
understanding of the Funds’ operations and regulatory environment to
ensure optimal oversight of the CEP and an appreciation of the environment in which the Funds operate.

-Ethical Integrity:
o Dedication and commitment to ethical conduct and promoting a culture
of compliance.
o Avoidance of conflicts of interest.
o Diligence in protecting confidences to the maximum extent consistent
with an effective compliance program.
o Sensitivity to budgetary concerns.

-Education and Certifications:
o A bachelor’s degree in a relevant field is typically required. o Relevant professional certifications.

-Communication Skills:
o Superb written and verbal communication skills.
o Excellent interpersonal skills in handling sensitive issues and
successfully navigating conflict and differences in opinion.

-Collaboration and Leadership:
o Ability to work collaboratively with the Trustees, the Executive Director and staff, and the Funds’ professionals.
o Leadership skills to guide compliance efforts and influence decision-
making.

About the Funds

The Funds collectively employ approximately 130 employees who are responsible for administering benefits for members of the New York City District Council of Carpenters (the “Union”), monitoring the contribution obligations of approximately 1,100 Contributing Employers to the Funds, and overseeing the Funds’ service providers, among other responsibilities. The Funds’ participants work in the construction industry in New York City. The Funds’ combined value exceeded $8.8 billion as of June 30, 2023. The Funds are governed by the Employee Retirement Income Security Act of 1974 and the Labor Management Relations Act of 1947. Note that the Funds are separate and distinct legal entities from both the Union and the Contributing Employers.

The Funds are based at 395 Hudson Street, New York, NY in a building that is jointly owned by the Pension Fund and the Apprenticeship Fund.
The Funds are overseen and administered by a joint Board of Trustees consisting of six union-designated and six employer-designated trustees, with the assistance of the Executive Director, the staff, and plan professionals. The Executive Director reports directly to the Board of Trustees, manages the Funds Office, and oversees the day-to-day activities of the Funds.

The Welfare Fund was established in 1950 and it operates a self-funded group health plan. It provides medical, hospital, dental, vision, prescription, life insurance, short-term disability, paid family leave, accidental death and dismemberment, scholarship and vacation benefits. The Fund has approximately 12,000 active participants and 7,000 retired participants and beneficiaries receiving benefits. It currently has assets of approximately $668 million.

In 1955, the Pension Fund, a defined benefit retirement plan, was established to provide financial security for NYCDCC retirees. Today, the Fund has approximately $4.6 billion in assets. The Fund currently has approximately 11,000 active participants, 12,000 retired or separated participants receiving monthly benefits, and 4,500 retired or separated participants entitled to future benefits.

In 1966, the Annuity Fund, a defined contribution retirement plan, was established to provide participants with additional economic security at retirement. Participants make their own investment decisions regarding their accounts. Today, the Fund has approximately $3.3 billion in assets and is managed by Empower.

The Apprenticeship, Journeyman Retraining, Educational and Industry Fund was created in 1966 to provide education and job training programs to apprentices and journeypersons. The Apprenticeship Fund operates the New York City District Council of Carpenters Training Center, also located at 395 Hudson Street in New York City, which provides the training programs to support workers and also the needs of the industry at large, helping to meet the challenges of emerging trends and address issues in the construction industry. The Fund currently trains approximately 817 carpenter apprentices and additional journey-level carpenters per year. The Fund has approximately $58 million in assets.

Welfare Dependent and Beneficiary Associate

DEPARTMENT: Welfare

POSITION REPORT TO: Welfare Manager

FLSA STATUS: Non-Exempt

POSITION PURPOSE:

The Dependent and Beneficiary Associate is responsible for accuracy of keypunching and indexing health enrollment requests for dependents and assigned beneficiaries into the Fund’s in-house computer system. corresponding with legal agencies regarding Qualified Child Medical Support Order requests. Handling claim audits due to dependent retro-terminations. Responsible for creating communications and retaining records regarding overpayment of claims due to retro-terminations.

 

ESSENTIAL JOB FUNCTIONS:

  • Ensures all pertinent documents has been received for dependent health enrollment and beneficiary requests
  • Enter member’s dependent and beneficiary information into databases from the enrollment forms
  • Review all data for errors and report any unusual findings to Team Lead
  • Scan and index all documents, correspondence pertaining to health enrollments and beneficiary assignments.
  • Corresponds with members, by all means of communication to request supporting documents needed to complete enrollments
  • Corresponds to interested parties regarding Qualified Child Medical Support Orders
  • Work following privacy guidelines as dictated by state and federal law
  • Ensure proper updates of required software
  • Special projects as they occur

 

EDUCATION & EXPERIENCE

  • High School diploma or GED
  • Exceptional knowledge of office computer systems and software
  • Experience working in data entry software and maintaining detailed information
  • Ability to effectively work within record software and update files accurately
  • Experience maintaining a professional level of privacy in accordance with HIPAA or other relevant regulations
  • Able to define decision criteria and determine the most appropriate course of action

Employer Assistance Representative

DEPARTMENT: Employer Services – Employer Assistance

POSITION REPORT TO: Employer Assistance Manager

FLSA STATUS: Non-Exempt

POSITION PURPOSE:

The Employer Assistance Representative frequently monitors the I-Remit website and Benefit Fund Administration system to provide an up-to-date account of an employer’s benefit reporting and/or delinquency status. Provides employers and District Council with phone support to facilitate collective bargaining agreement compliance.

 

ESSENTIAL JOB FUNCTIONS:

  • Refer delinquent employers to the District Council for further action
  • Monitor employer benefit payments via the I-Remit website, Benefit Fund Administration system, and daily deposits
  • Request the addition and removal of companies from the District Council’s Further Action list
  • Review and update employer status such as active, inactive, dormant, and shut down
  • Provide phone support to employers for delinquency issues, benefit breakdown calculations, and proper reporting procedure questions
  • Review remittances, benefit shortages, surety, and discrepancy delinquency reports and maintain inter­departmental communication
  • Assist employers regarding adjustments to already reported benefits submitted
  • Verify the accuracy of responses sent by employers
  • Forward refund request with supporting documents to the Remittance Department
  • Assist Business Representatives via email, telephone or in person to verify information they receive while working in the field is accurate
  • Inform District Council’s Job Tracking Department of any issues with jobs
  • Provide instructions to employers who are paying benefits online or check
  • Delete/void I-Remit reports
  • Setup and/or re-set passwords on I-Remit/URBAN
  • Generate letters related to employer status

 

ADDITIONAL JOB FUNCTIONS:

  • Maintain a list of employers’ delinquent in benefit payments
  • Monitors all employers to determine current status with benefit reporting and payment obligations as per their Collective Bargaining Agreement
  • Daily maintenance of employer statuses on the Benefit Fund Administration, URBAN
  • Notify District Council of employers reporting benefits while shut down
  • Maintain a detailed phone log of conversations with employers
  • Produce various reports and queries (i.e., jobsite tracking and employer records) requested from employer
  • Inform Member Services when employer encounter issues with participant’s name and SSN on the I-Remit/URBAN so the issue can be properly resolved

 

KNOWLEDGE, SKILLS, AND ABILITIES:

  • High school diploma or equivalent required; Some college preferred or at least two (2) years customer service experience
  • Knowledge of Microsoft Word, Excel, and Outlook
  • Strong customer service skills
  • Strong oral and written communications skills
  • Ability to multitask between analysis programs, phone, and data entry spreadsheets
  • Knowledge of Auditing Systems and Benefit Fund Administration Systems
  • Must be able to adapt to a fast-paced department

Scheduling Coordinator (Carpenters Training Center)

REPORT TO: Assistant Director of Training

POSITION PURPOSE:

We are seeking a highly organized and detail-oriented Scheduling Coordinator to join our dynamic team. As a Scheduling Coordinator, you will play a vital role in coordinating and managing the training schedules for our carpentry programs. You will be responsible for ensuring that all training sessions, workshops, and classes are scheduled efficiently and effectively, while also maintaining accurate records and managing any changes or updates to the schedule.

 

ESSENTIAL JOB FUNCTIONS:

  • Develop and maintain the class schedule for all apprentice and journey level carpentry and specialty training programs.
  • Coordinate with instructors, members, and other staff members to ensure smooth execution of training sessions.
  • Manage and update the training schedule in real-time, ensuring accuracy and timely communication of any changes or cancellations.
  • Collaborate with the training team to identify scheduling conflicts and develop solutions to optimize training resources.
  • Timely and effective communication with members (apprentice and journey level) regarding their training schedule.
  • Assist in coordinating logistics for training sessions, including room setup, equipment, and materials.
  • Maintain and update accurate records of attendance, training hours, and other relevant data.
  • Collaborate with the administrative team to ensure proper documentation and compliance with training regulations and requirements.
  • Support the training team in evaluating and improving the effectiveness of the training schedule and processes.

 

EDUCATION & EXPERIENCE:

  • High school diploma or equivalent.
  • Minimum of 1-2 years’ experience in creating and maintaining scheduling of classes.

SALARY AND BENEFITS:

Salary Range: $53,000-$57,000

The hourly rate for this position is based on the General Foreman rate of the Collective Bargaining Agreement; currently $61.05 per hour.

Part-Time Instructor (Commercial Diver Pile Jacket Class)

The New York City District Council of Carpenters Training Center is seeking a part-time instructor with a minimum of 10-15 years’ work experience with knowledge of means and materials used by commercial Dock builder/Diver with experience in pile jacketing.

 

JOB RESPONSIBILITIES:

  • Organize and present program of practical and technical instruction on Pile Jacketing principles, means and methods, including demonstrations of skills required in trade, and lectures on theory, techniques, and terminology. Plan and supervise work of our members, individually or in small groups. Observe members and answer questions.
  • Instruct members in subject areas such as tool and equipment maintenance, building codes and regulations and safety precautions related to pile jackets.
  • Instruct journey level members, implementing course material, and maintaining cohesive multi-level group dynamics.
  • Maintain inventory and equipment records within assigned classroom and work space.
  • Assure that all students abide by the guidelines, policies and rules and regulations as set by the Carpenters Training Center.
  • Test and evaluate achievement of students in technical knowledge and trade skills.
  • Maintain attendance records, and task sheets. Add new projects in coordination with administration including any new products or technologies new to the industry.
  • Recommend or suggest changes for the improvement of the training program.

 

REQUIREMENTS:

  • Knowledge of training theory and its practical application.
  • Demonstrates a solid understanding of commercial construction in NYC.

  • Willing to and possesses the ability to be cross trained in all areas in commercial Dock building/diving.

Certified/Licensed Counselor/Clinician

TITLE: Certified/Licensed Counselor/ Clinician

DEPARTMENT: Member Education and Network for Dependency (“MEND”)

FLSA STATUS: Non-exempt. Part-Time (possibye to Full-Time)

 

POSITION PURPOSE:

Service membership, as well as dependents, of the New York City District Council of Carpenters Welfare Fund with mental health issues including, but not limited to: referrals for inpatient rehabilitation, intensive outpatient, outpatient treatment, and case management.

 

ESSENTIAL JOB FUNCTIONS:

PROVIDE REFERRALS

  • Provider referrals to members and/or dependents, consistent with treatment needs, coverage, and location.
  • Conduct thorough assessments for appropriate level of treatment and length of stay.
  • •Conduct psychosocials when applicable.
  • Verify eligibility for coverage and complete Utilization Review form.
  • Act as a liaison with insurance company and treatment facilities.

 

PROGRAM AND CASE MANAGEMENT

  • Maintain confidential written and electronic records.
  • Ensure legislation standards and guidelines are being followed.
  • Collaborate with facilities on progress and effectiveness of treatment.
  • Maintain statistics for the program and identify trends.

POSITION PURPOSE:

  • The Mailroom Clerk is responsible for receiving, sorting and distributing mail throughout the organization. They are also responsible for maintaining mailroom and office inventory.

ESSENTIAL JOB FUNCTIONS

  • Maintain inventory of office, mailing and printing supplies.
  • Receive, sort and deliver mailings and shipments to their respective recipients.
  • Collect all outgoing and interoffice mail from designated drop-off bins throughout the organization floors.
  • Request and process mailing authorizations using the Funds’ mailing software.
  • Operate printers, inserter, and postage machines to send out bulk mailings.
  • Prepare, process, and handle outgoing shipments and certified mailings.
  • Deliver mail and packages to the Post Office or designated courier drop off locations.
  • Track and maintain records of mailings, created labels, and mailroom related invoices.
  • Organize and maintain cleanliness of the mailroom.
  • Carry or transfer heavy packages from the loading dock to their designated storage.
  • Scan mailing related documents and records to the Funds’ document management system.
  • Help staff with mailing related issues or concerns.

EDUCATION & EXPERIENCE

  • High School Diploma or G.E.D. Certificate.
  • Basic knowledge of Microsoft Word, Excel and Outlook.
  • Inventory management or bookkeeping experience.

REQUIRED

  • At least one (1) year of experience working in mailroom environment.
  • Technical knowledge of printers, inserters, and postage machines.
  • Ability to multitask and excellent time management.
  • High attention to detail.
  • Must be able to lift 40 lbs. or above.
